I found this article this morning. It's important to keep in mind if you ever discuss personal issues in Gmail or if you've ever passed on private financial details to anyone using Gmail.

Frankly, any email may not be private. I always advise my clients if they are going to send me information that contains personal info via email to send it as an encrypted attachment and to telephone me and give me the passcode to open the document. I would rather they send me the information some other way, but some clients prefer email. But an encrypted document probably still could be accessed by law enforcement in a criminal investigation or by a skilled hacker...

Old news? Not the court ruling, but the privacy issue was in a Huffington Post article at least a year ago.

I've never considered anything I email, private message, blog, google, etc. to be private. Best thing is to not write it down or even speak it on the phone. I guess if I sound paranoid, I am!

Best news is that it's a circuit split...the article itself notes that the decision is at odds with decisions in other circuits. If you're in New York, you're a little SOL at the moment, but other jurisdictions don't have that rule. Which also means it's sort of ripe to be brought up to SCOTUS.........not that they'd do much with their current track record.

Email has never been private.

You should never send information in an email that you wouldn't want to broadcast on tv.

The privacy issue itself is not new news, no. Virtually nothing online is totally private, or they wouldn't be able to do things like target people with certain ads. But more boundaries are being crossed all the time.

I posted this partly because it has me wondering if there are other e-mail options. Also because so many of us use e-mail to chat about our personal lives and our opinions, and we should probably be rethinking this. One of the new ways of receiving bills is via e-mail, too.

I'm not the paranoid type, and I don't want to live that way. I'm just wondering "out loud" if there's a better way to do this.

How do you yourself discuss personal information? I'm not being facetious or nosy, I'm just curious. Phone conversations are also not as private as they once were, now that most people use cell phones. It's a strange society that communicates mostly via technology, but where the only way to have a private chat with someone is in person. More in-person time with fellow humans is a very welcome thought! But there are times when we need to use technology to communicate. What should we do?

Well, there is personal and there is personal.

What I meant was don't put your SS# in an email. If you want to discuss your lumbago, knock yourself out.

If I was in the middle of a nasty multi-million dollar divorce, I wouldn't email details of my bank account to my lawyer.

As someone said, things can be encrypted and sent as attachments in an email.

Phone calls have never been private. Even landlines. In some (US) states it is legal to record a phone conversation as long as ONE of the parties is aware of it. That means someone can record a telephone conversation they are having and the other party may not know it.

Face to face conversations have always been the only way to have a totally private conversation. And you better trust the other person.

I'm not paranoid about these things, by the way. I am aware of it and act accordingly.
